Litigation Support Summary
The United States Department of Justice required a study of racial patterns in the hiring of teachers in a Texas school district. By combining the district's applicant files with data from the U.S. Census and several other sources, Econsult Corporation collected, edited and organized a large computerized database, which became the foundation for a statistical study and subsequent testimony on hiring practices. Consistent with the expert analysis, the court ruled that the school district had discriminated on the basis of race.

A university needed to examine whether gender had affected either initial school appointments or promotions of its faculty. Econsult constructed a database on employment practices from computerized payroll files. That database formed the basis for testimony on faculty hiring and promotion. Based in part on our analysis, the court ruled that the university had not discriminated.

The U.S. Office of Federal Contract Compliance Programs (OFCCP) retained Econsult Corporation to analyze gender patterns in hiring of production workers in a major manufacturing facility. Econsult personnel created a large database from the employer's computerized personnel records and used that data to analyze each stage of the hiring process to evaluate its relative importance in reducing the number of women hired. The evaluation of economic damages performed by Econsult Corporation was used to reach a settlement.

Attorneys, representing African-American white collar employees of an international corporation that manufactures and distributes soft drinks, requested an analysis of racial bias in promotion and compensation among corporation employees. Econsult Corporation performed extensive statistical analyses that showed that promotion and compensation were not racially neutral. After a settlement was reached (the largest settlement in a racial discrimination case in U.S. history), Econsult Corporation developed and implemented a method for allocating the cash settlement to individual class members.

After a firm-wide layoff at a large defense plant, employees claimed that they were selected for layoff because of their age. Econsult prepared a statistical analysis that showed that an employee's age affected the likelihood of layoff, after considering differences in layoffs for particular job titles. The court certified the class. An Econsult expert testified at trial. A jury found in favor of the class members.

Econsult experts have assisted both individual plaintiffs and defendants with individual employment discrimination matters.
